Hi everyone — I wanted to help clear up some confusion that’s circulating about the data center discussion. There is a rumor that the project has already been approved. That is not correct.
Here are the verified facts:
1. A Special Use Permit (SUP) was issued on August 27, 2025.
This was not a construction approval.
It was a conditional permit — meaning the developer must meet 17 required conditions before anything can move forward.
2. The company has two years from that date to meet all 17 conditions.
The SUP expires on August 27, 2027 if the developer does not complete every requirement.
3. None of the major conditions have been met yet.
These include independent reports and plans such as:
Emergency Response Plan
Full Battery Energy Storage System (BESS) development plan
Environmental impact analysis
Noise study
Drainage & hydrology compliance
FAA glare analysis
Road improvement engineering
Decommissioning plan
Bonding/financial assurance
Water plan
Lighting plan (Night Sky Act)
Hazmat training & fire suppression requirements
Without these, the project cannot advance.
4. No construction permits have been issued.
No building permit.
No site development permit.
No engineering approval.
No green light to begin construction.
5. No vote or final approval has occurred.
The County Commission has not taken any action beyond the conditional SUP.
6. The August 10 meeting is informational only.
The Roswell–Chaves County EDC scheduled this session so residents and local leadership can:
ask questions
understand infrastructure impacts
hear from policy experts
learn about regulatory requirements
get factual information
It is not a vote, and not an approval meeting.
7. Here is the actual approval process in Chaves County:
For any project to be approved:
A formal application must be submitted
Planning & Zoning must review it publicly
A public hearing must be held
Residents must be notified
Commissioners must vote in an open meeting
Only then can a project be approved
None of these steps have happened.
Why I’m posting this
It’s important that our community works from verified information, especially when large projects are being discussed. Misinformation helps no one — and it makes it harder for residents to participate meaningfully.

Where’s the discharge plans. MSDS chemical plans, anti bacteria growth remediation plans, Reclaimation of used water diagrams abd equipment., Purification of water flushed out of the system methods. Water testing frequency requirements ADDRESSED and plans they will follow?
Residents expect the Township Board to hold its contractors accountable. Instead, citizens are volunteering their own time to catch the vital details McKenna missed. The firm failed to properly account for necessary power lines, airport location restrictions, and drainage easements. Furthermore, bypassing the Zoning Board to drastically reduce parking requirements sets a dangerous precedent.
We have also connected with the folks in Salem, Oregon where Verrus is also attempting to build another data center. In one of the documents shared with their community regarding water usage for a building using the same technology as ours, they’re estimating over a million gallons of water a day, when they told us it was in the hundreds of thousands. Better yet, the water table they gave to them is labeled as Project Flex, which is not the name of their project. So more inconsistencies from Verrus and now we can cross check them. We need the township to ask better questions because Salem didn’t get an answer of “just toilets and the break room”.
